Public Information Act
Under Texas Law (Government Code, Chapter 552), the public has the right to request access to most county records (information already in existence). Polk County officials and departments are expected to promptly release records that are not confidential by law, unless an exception to disclose exists or an Attorney General's opinion is sought. Texas Government Code Section 552.108 exempts certain law enforcement records from public disclosure, including information in relation to pending court cases, open investigations, and investigations or cases that did not result in a conviction or deferred adjudication. The Act does not require a governmental body to create new information, answer questions, or do legal research. For FAQ regarding the Public Information Act, please visit the Attorney General's Website.
To Submit a Public Information Request to Polk County
All requests must be in writing via mail, email, fax, or in person to the appropriate county department. If you are seeking information from the courts or another elected official, please contact that office directly. Specific departmental addresses, fax numbers, and emails can be located on this county website. Please include as much description and detail (including timeline) as possible to enable the county to identify and locate the records being requested.
